CanQuer ("we," "our," or "us") operates an integrated oncology SaaS platform, including the Oncologist Clinical Dashboard and the Patient Companion App. We are committed to protecting the privacy and security of our users, including patients, oncologists, nurses, and healthcare administrators.

This Privacy Policy explains how we collect, use, process, and safeguard your data in compliance with the Digital Personal Data Protection (DPDP) Act, 2023, and guidelines set by the National Cancer Grid (NCG).

1. Information We Collect

We collect data necessary to facilitate chemotherapy toxicity management, Multidisciplinary Tumor Board (MDT) governance, and remote patient monitoring.

A. Personal Information (Data Principals)

• Identity Data: Name, age, gender, and contact details (phone number, email address).

• Professional Data (for Clinicians): Medical registration number, specialization, and hospital affiliation.

B. Sensitive Personal Data (Health Data)

• Clinical Records: Cancer stage, tumor type, comorbidities, and medication history.

• Toxicity & Symptom Data: Real-time logs of side effects (e.g., nausea, fever) graded against CTCAE standards (Common Terminology Criteria for Adverse Events).

• Diagnostic Reports: Pathology reports, radiology images (PET-CT, MRI), and lab results uploaded for MDT review.

• Treatment Data: Chemotherapy cycles, dosage, and adherence records.

C. Technical Data

• Device information, IP address, and usage logs from the Patient App and Clinical Dashboard to ensure security and auditability.

2. Purpose of Data Processing

We process your data for the following specific purposes:

1. Clinical Decision Support: To triage symptoms via the Toxicity Command Centre and flag "Critical" or "Red Flag" events to your care team.

2. MDT Governance: To document case presentations, discussions, and consensus decisions during Tumor Board meetings as per NCG guidelines.

3. Care Coordination: To send automated nudges for medication adherence and follow-up appointments.

4. Quality Improvement: To analyze aggregated, anonymized data for improving clinical outcomes (e.g., reducing ER admissions and treatment dropouts).

5. Legal Compliance: To maintain audit trails of clinical decisions and toxicity escalations as required by medical liability standards.

3. Consent and Authorization

• Explicit Consent: By using CanQuer, you act as the Data Principal and grant us Consent to process your digital personal data for the specified medical purposes.

• Caregiver Consent: If a caregiver uses the app on behalf of a patient, they confirm they have the authority to provide consent for the patient.

• Withdrawal of Consent: You have the right to withdraw consent at any time by contacting the Grievance Officer. Note: Withdrawal of consent may limit our ability to provide remote monitoring and triage services.

4. How We Share Your Data

We do not sell your personal data. We share data only with authorized entities involved in your care continuum:

• Your Healthcare Providers: Treating oncologists, nurses, and clinical assistants who monitor the Triage Queue.

• MDT Specialists: Radiologists, Pathologists, and Surgical Oncologists participating in your case review (potentially across different NCG centers).

• Hospital Systems: Integration with Hospital Information Systems (HIS/EMR) for permanent medical record keeping.

• Regulatory Bodies: If required by law or for compliance with schemes like AB-PMJAY (Ayushman Bharat) for claims processing.

5. Data Security and Retention

• Security Measures: We employ role-based access controls, encryption, and robust audit logs to ensure DPDP-ready security. Only authorized clinical staff can access sensitive health data.

• Data Retention: We retain medical data for the duration required by Indian medical regulations (typically minimum 3 years for OPD and longer for IPD/MDT records) or as long as necessary to provide continuity of care.

6. Your Rights (Data Principals)

Under the DPDP Act, 2023, you have the right to:

1. Access: Request a summary of your personal data being processed.

2. Correction: Request updates or corrections to your medical or personal data.

3. Erasure: Request deletion of your data, subject to retention requirements under medical laws.

4. Grievance Redressal: Register a complaint regarding the processing of your data.
